Terms of Service

1. Introduction

Welcome to InnQuizzitive ("InnQuizzitive", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the InnQuizzitive website at innquizzitive.com and our related services (collectively, the "Service").

The Service is operated by Lotus River AI, a sole proprietorship registered in Singapore ("the Company"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Accounts

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You must provide accurate and complete information when registering.
  • You must notify us immediately of any unauthorised use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law;
  • Upload content that is unlawful, discriminatory, defamatory, or infringes the rights of others;
  • Attempt to gain unauthorised access to the Service or its systems;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Resell, sublicense, or commercially exploit the Service without our written permission;
  • Use the Service to make hiring or employment decisions in a manner that violates applicable employment or anti-discrimination laws. You are solely responsible for ensuring your use of quizzes and screening complies with the laws that apply to you.

5. Customer Data and Candidate Information

  • You may upload or generate content, including menus, quizzes, questions, and information about your staff or job candidates ("Customer Data").
  • You retain ownership of your Customer Data.
  • You grant us a limited licence to host, process, and display Customer Data solely to provide the Service to you.
  • You are responsible for ensuring you have the legal right and any necessary consents to collect and process information about your staff and candidates through the Service. Our handling of personal data is described in our Privacy Policy.

6. Subscriptions, Billing, and Payment

  • Paid plans are billed in advance on a recurring basis (monthly or annually) via our payment processor, Stripe.
  • By subscribing, you authorise us to charge the applicable fees to your payment method on each billing cycle until you cancel.
  • Fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes.
  • We may change our prices with at least 30 days' notice. Changes take effect at your next billing cycle.
  • Cancellation and refund terms are set out in our Refund & Cancellation Policy.

7. Free Trials

If we offer a free trial, we will tell you the trial length at sign-up. No payment card is required to start a trial. When the trial ends, your trial simply expires and you are not charged unless you have chosen a paid plan and added a payment method. To continue after the trial, you add a payment method and subscribe.

8. Intellectual Property

The Service, including its software, design, branding, and content (excluding Customer Data), is owned by the Company and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

9. Service Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Quizzes and AI-generated content may contain inaccuracies, and you are responsible for reviewing any output before relying on it.

11. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold the Company harmless from any claims, damages, or expenses arising from your use of the Service, your Customer Data, or your violation of these Terms.

13. Termination

We may suspend or terminate your access if you breach these Terms. You may cancel your account at any time. On termination, your right to use the Service ends, and we may delete your Customer Data after a reasonable period as described in our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Continued use after changes take effect constitutes acceptance.
